Terms and Conditions of Purchase
These Conditions of Sale are applied in full compliance with current regulations on distance selling with particular reference to the Consumer Code (Legislative Decree No. 206 of September 6, 2005).
Scope of application
These general conditions of sale apply to purchases and sales of rose' s roses products concluded at a distance through the website http://www.rosesroses.it www.rosesroses.it and must be carefully reviewed by the customer before the completion of the procedure of distance purchase of the indicated product. It is understood that the placing of the purchase order, through the website http://www.rosesroses.it , implies total and absolute knowledge of these general conditions of sale and their full acceptance: the customer, by placing the purchase order through the website http://www.rosesroses.it , accepts unconditionally and is obliged to observe, in his dealings with rose's roses s.r.l., the present general conditions of sale, as well as the conditions of payment illustrated below, declaring that he has read and accepts all the indications provided to him, and also takes note that rose's roses considers itself bound to conditions different from the present, if not previously agreed in writing. These general conditions of sale are to be considered applicable and in force as long as the same are published on the website http://www.rosesroses.it
If the company rose's roses s.r.l. should change the general conditions of sale in question, notice will be given by publication on the site and the new general conditions of sale will apply only to orders placed from the day of their publication.

Information regarding rose's roses products susceptible to distance selling through the website http://www.rosesroses.it are provided in accordance with applicable laws.
The order can be placed through the "Shop" section of the website http://www.rosesroses.it , following the steps and instructions specified on the site itself.
At the successful conclusion of the payment process by the customer, rose's roses will give immediate notice to the customer of the acceptance of the order, reserving the right to communicate, within 5 days after the same, the possible inability to process the order itself, which will be followed by the immediate cancellation of the order and the simultaneous release of the amount committed, whether due to the supervening exhaustion of goods or force majeure or if the order does not correspond to normal consumption needs. This requirement applies, both in relation to the number of products purchased with a single order, and in the case of a plurality of orders relating to the same product, and this even in the case where each order includes a quantity of products corresponding to normal consumption needs.
Prices and Currency
The product price published on the site is for the individual item, expressed in euros displayed including VAT and including shipping costs
In accordance with the provisions of Article 53 of the Consumer Code, the customer receives, at the time of acceptance of his order under Article 4) of these Terms of Sale, written confirmation containing information about the products ordered, the amount paid, details of the price of each product, as well as the existence of the right of withdrawal, the time and method for returning the goods, the geographical address of the headquarters of rose's roses and information about the support services and any existing commercial guarantees.
Prices posted on the site, payments, and order invoices are in Euros.
The amount that will be charged to your Paypal account may vary as it is based on floating exchange rate regimes and bank fees.
rose's roses encourages customers to contact their banking institution to request detailed information on exchange rates and bank fees related to their transaction.
Forms of payment
The following forms of payment are accepted by rose's roses s.r.l.
Choosing payment by Bank Transfer, at the conclusion of the order the customer will receive a confirmation email containing the bank details of rose's roses s.r.l., following which the goods are set aside pending the arrival of the transfer to the account.
The customer is required to send a copy of the payment by FAX or e-mail within 48 hours of receiving the order confirmation.
If by that time rose's roses does not receive a copy of the payment, it will cancel the order.
We will ship the order when the transfer has reached our bank account and as soon as the goods are available in our warehouse.
By choosing the PAYPAL payment method, the customer can pay directly through their Paypal account.
rose's roses reserves the right to ship goods only to the address listed on the account verified by Paypal.

Shipments to Italy, San Marino and Vatican City are made by DHL courier and are free of charge.
International shipments, on the other hand, are made by courier and will be added to the price of the item depending on the country indicated for shipment (Europe, Asia, America and all others not part of the Italian state).
As required by the laws governing trade, all rose's roses shipments are accompanied by an official invoice stating the value of individual items in Euros.
Delivery of the products is made to the address indicated by the customer only after regular payment of the order submitted to rose's roses.
In compliance with the provisions of Article 54 of the Consumer Code, rose's roses s.r.l. undertakes to deliver the products duly ordered in accordance with the procedures indicated and agreed upon, no later than 10 days from the day on which the customer has made payment.
In the case of unavailability of the consignee or other person authorized to receive the shipment at the time of the delivery attempt, the express courier will issue a paper notice containing details about the delivery attempt made and the codes and contact information that will allow an appointment to be arranged with the courier for the next delivery.
If the courier does not receive different instructions from the customer, it will make two additional delivery attempts, which, if ineffective, will decree that the shipment will be placed in storage for 5 days at the shipper's expense.
Beginning with the placing in storage mentioned above, rose' s roses will contact the customer via the contact information provided by the customer at the time of the registration process in order to ascertain and resolve any problems that have occurred.
In case of no response or inability to agree on a delivery within the 5-day period mentioned above, the order will be cancelled and the customer will be notified by e-mail, who will be credited with the amount paid net of shipping costs .
In the event that both of the following conditions occur:
1) delivery of the product(s) to the customer does not occur within 10 business days following the date of shipment, as contemporaneously notified to the customer by rose' s roses;
2) it had become impossible for the customer to trace the location of the said goods with the help of the courier's online computer system;
the customer would, in this case, be obliged to notify rose's roses of the non-delivery of the product(s), through an email sent to email@example.com and rose 's roses would undertake to ensure a new shipment of the lost product(s) within 48 (forty-eight) hours after the report; if, after such communication, rose's roses finds the unavailability of such product(s) the order would be immediately canceled and the simultaneous refund to the customer of the amount paid would take place.
If for any reason the customer is not satisfied with their purchase, unworn items can be returned for size exchange or refund within 10 days from the date of receipt of goods.
To request return authorization, the customer must send a request to the address firstname.lastname@example.org
The e-mail must specify the codes of the items you intend to return and the desired compensation: size exchange or refund. Upon receipt of the return request, rose's roses will send the Customer a written confirmation, containing the Return Authorization Number (R.A.N.).
the return must be made with the courier indicated in the waybill already attached to the shipment, the return of purchased products is free of charge, except for products on promotion , whose return will be charged to the customer and will be deducted from the refund.
The client can choose 2 types of compensation:
It is possible to exchange only for a different size or color of the same item, if available. It is not possible to exchange the item for a different item.
There is only one merchandise exchange and it is free of charge for each item.
Refunds will be processed as soon as you complete the receipt, verification and acceptance of the returned item.
For orders paid by Paypal or bank transfer, the amount will be returned to the original account.
Refunds will be issued in the same currency as the original purchase. Any difference in amount due to exchange rate fluctuation cannot be refunded.
The return shipment must be made within 10 days of receiving the order.
Items to be returned must not have been worn, washed or altered and must not show any signs of use. Shoe soles must be in perfect condition and show no marks of any kind.
All footwear must be returned together with their original box, labels and original supplied accessories (logoed cloth bag), which are considered to all intents and purposes an integral part of the product itself and must not have been damaged and/or altered in any way, nor used as the only outer packaging.
Returns must be shipped within the same packaging used for delivery
In the event that the customer receives defective merchandise, or that errors occur in shipments by rose's roses, the customer is asked to follow the same instructions as above.
rose's roses ltd reserves the right to refuse unauthorized returns, sent by couriers other than the one indicated in the email with instructions to return, or otherwise not in accordance with all the conditions provided.
In such cases, the goods will be returned to the sender at the original shipping address.
